BRACKNELL, Berkshire – March 25, 2010 – Eagle Technologies Ltd (Eagle) today announced it has filed two Patent Opposition Notices at the European Patent Office as part of its defence against Datacard Corporation (Datacard) patent infringement claims.
Datacard served two patent infringement law suits against Eagle, the first in November 2009 and the second in Jan 2010
Eagle remains confident that it will prove in the hearing at the High Court in London (scheduled for January 2011) that both patents are invalid due to lack of novelty and inventive step, and have requested they be revoked.
Eagle has forwarded its oppositions to the European Patent Office for determination. A spokesperson for Eagle said ‘by filing oppositions centrally at the European Patent Offices Eagle has the potential to overturn Datacards two patents in all relevant member states thus preventing the need to overturn them in each country’.
A basic patent search shows that the original Datacard patent applications had been outstanding since 2002 and 2003 respectively and were only granted mid to end of 2009 when Eagle had released a low cost range of high quality compatible ribbons under the brand name Plus-Ribbon.
